  1. For the individual lawyers a loss after trial is far worse than a settlement, especially if the settlement is under NDA. Even for SEC lawyers a loss follows your career, especially a high profile loss.

  2. Great perspective! Sec does not have anything to lose by taking it to trial. Let’s hope Congress step in and harness their jurisdiction.

    If those SEC staff are not there on behalf of the SEC, who is paying for their trips? I think this was brought up before. If you are not attending on behalf of the SEC, they should be paying for the entire trip themselves.
    I'm sure we know the answer to this one though.

  4. From what I've seen and understand, isn't the possible establishment of a fair notice defence precedent the big deterrent for SEC in terms of taking this all the way to judgement? Also, I personally wouldn't overestimate Ripple's "white knight" attitude in terms of seeking clarity on behalf of the whole crypto space. I mean, sure, if it can be achieved relatively painlessly and cost effectively, great…but seems to me we're well beyond that point with regard to both effort and cost. At some stage don't Ripple just focus on getting what they need from the case and let everyone else deal with the SEC on their own terms?

  5. I would love to know if Mike Novogratz was on that email list, and where he fits in all of this… I think he's well and truly in the mix of this whole rotten mess as well. Helping oil the cogs in this scheme, from a distance looking at his diamonds.
